  • I work on legal end of the invention industry. Some inventors are so caught up in prototyping or selling there idea most rarely consider properly documenting the idea. Many are still under the false belief of a "poor mans patent" I spend hours consulting new and experienced inventors on setting a game plan before actually filing a patent.   • I've heard from a number of sources that if you bring a product to market (execution) before applying for a patent, you've then created prior art and cannot file for a patent later. So while I agree that execution is key, make sure you file provisionally before announcing or selling the product publicly. - Michael Luby

  • There's something you forgot to consider. Without patents, it would make more sense for the big corporation to sit back and see if my invention is successful or not *before* they come out and rip me off. How else are they supposed to know the difference between a stupid invention like a chin putter (#6659880) and something like the Wright Brothers' plane? If my invention is successful, a patent would mean excessive profits for me. If it isn't, a patent would be completely useless. - wiimooden

  • If I have a giant company as big as Microsoft, the first thing I'll eradicate first is PATENT, release all my software with their source codes for free, share my ideas around the world and support their idea... About 3 years ago I evolved on the idea after having a dream (I know it's weird) As I was young (14 years young) I never thought about patent it, I really wish I did now. I started to write a website called The Cloud. And then soon after Apple released the iCloud. That was exactly the same as The Cloud. Recently an American company patented Neem as pesticides. And the hell you know what ... They patented cow urine as cancer resistant. Yes Cow urine us Patent no. 20020164378. search it.   • That's right, while in some countries like the US the relevant is "the first to invent" in other countries (specially in europe) the "first to file" applies, so in order to avoid the problem of losing novelty of your invention file an application and then you market it (in my opinion). - ArguelloTony

I don't know which structure to choose but I know I am NOT interested in sole proprietor or partnership...I know I would like to be able to sell stock but not in the beginning...and I know I can do that with an LLC, a C Corp or an S corp.
